Derivatives and ISDA Documentation

This intensive programme provides an in-depth understanding of the key legal aspects of derivatives, the *ISDA® Documentation architecture and a clause-by-clause analysis of the ISDA® Master Agreement 2002. A comparison of the ISDA 2002 and 1992 Master Agreements will be covered along with the key negotiation points – including the questions to ask depending on who you act for – relevant in negotiating ISDA Master Agreements.

The ISDA Credit Support Annex will be examined along with the settlement netting, close-out netting and the legal issues around collateral. The programme also covers EMIR, and the initial and variation margin requirements together with the ISDA SIMM™ Model and other pertinent US regulations (Dodd Frank and FATCA) that impact derivatives trading.

Workshops and case studies will be applied throughout allowing participants to work together in small groups to draft and negotiate a first draft of the ISDA Schedule to the 2002 ISDA Master Agreement in accordance with the client instructions provided in the case study pack.

Participants are required to bring their own copies of the 2002 ISDA Master Agreement and 1995 ISDA Credit Support Annex.
